Before I get into this most important information I must states some facts that have arisen lately. It concerns CAN SPAM Laws. If you are a non-profit 501c3 or A 527 Political PAC as we are and legally registered the CAN SPAM law does not refer to you. That’s Federal Law. If an IPS or Hostingsue Company threatens or rather takes you down because of spam you can so easily in federal court. The violation of this is far more severe than is the laws pertaining to true spammers. There is a large law firm that will take your case on a contingency. This is becoming a growing issue especially with Political PACS. If someone does not like your movement or opinion they simply report you to your IPS or hosting company. So many times they react with out even as much as giving you a reason and many times they are breaking Federal Law which is quite deadly to them financially and easily provable. So much that this law firm based in Atlanta, Delaware, New Jersey, and D.C. is willing to take your case , and there fee is based on your recovery of damages. You know lawyers do not risk losing a penny. The law was written by politicians and you know they protect themselves so they made sure political organization were not subject to CAN SPAM. Even though we are not subject to it we still provide a unsubscribe link on our emails. We normally only email members so we have not had to unsubscribe yet we got reported for spam. We inquired with our legal advisers and they put us on this law firm. I learned a lot about this law, and how to protect yourself. I hope we resolved our issue, and if not. Well, we will be in federal court free of charge with the violators paying heavy fees, and damages fees. That would be a nice contribution to our cause, and the false reporter if found could be imprisoned which would not hurt my feelings. It may be a good idea to in advance let your ISP and hosting service no your non profit and tell them this. In this day and age folks get mad and will lie in a flash. Now we know there are severe penalties for this.
CAN SPAM targets commercial email only. Emails trying to sell products and service. It is sad when an ISP or Hosting Company is not aware of the Law. It would be my suggestion that any ISP or Hosting company check into this very thorough before cutting someone off, and get up to speed on the laws. The reason is there are some of us that do know the law, and will have it enforced. I am one.
